Terms of Use

The rules of the game — for the game.

Welcome to MineDown. By downloading, installing or using the MineDown mobile game ("the game", "we", "us", "our"), you agree to these Terms of Use ("Terms"). If you don't agree, please don't install or use the game.

MineDown is published by Tafi Games, an independent game developer based in the Republic of Türkiye. You can reach us at info@minedowngame.com.

1. Acceptance and eligibility

By using MineDown you confirm that (a) you have read and accepted these Terms and our Privacy Policy; (b) you have the legal capacity to enter into a binding agreement in your country, or, if you are a minor, that a parent or legal guardian has accepted these Terms on your behalf; and (c) you are not located in a country subject to a comprehensive U.S. Government embargo, and you are not listed on any U.S. Government list of prohibited or restricted parties.

2. License

We grant you a personal, worldwide, non-exclusive, non-transferable, revocable, royalty-free license to install and use MineDown on devices you own or control, for your own non-commercial entertainment. You may not:

  • Reverse-engineer, decompile or disassemble the app, except where local law explicitly allows it.
  • Re-distribute, sublicense, sell, rent or lease the app.
  • Use the app to violate any law, harass other people, or harm any system.
  • Attempt to bypass ad serving, the "Remove Ads" entitlement check, in-app permissions, content filters, or any other technical measure.
  • Use automated means (bots, scrapers, emulators) to play, score, or interact with the game in a way that abuses the systems or other players.

3. Ownership

All rights in MineDown — including artwork, source code, game design, music, sound effects, names and branding — belong to Tafi Games or its licensors. The license above does not transfer any ownership to you. All rights not expressly granted are reserved.

4. Updates

We may release updates that change, add or remove features at any time. Some updates may be required to keep using the game. You are not obligated to install them, but older versions may stop working if the supporting services change.

5. Third-party services

The game uses third-party services such as Google AdMob, the App Store and Google Play. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services.

6. Ads and in-app purchases

MineDown is supported by ads. You may see interstitial ads (between game sessions) or rewarded video ads (when you tap the Revive button). Rewarded ads are always optional and require an explicit tap from you. We do not control the specific ads served by Google AdMob. If you see an ad that violates our guidelines or applicable law, please let us know at info@minedowngame.com.

For users in the European Economic Area, the United Kingdom or Switzerland, ad consent can be reviewed or changed at any time via Settings → More Settings → Ad Preferences in-game.

MineDown offers a single one-time, non-consumable in-app purchase, "Remove Ads", which permanently disables interstitial ads for you. Rewarded (Revive) ads remain available if you choose to use them. All billing, payment, refunds and chargebacks for in-app purchases are handled exclusively by Apple or Google under their store policies — we do not process payments ourselves and cannot issue refunds directly, so please contact Apple or Google for any billing or refund request. Because "Remove Ads" is a non-consumable product, you can restore it free of charge on your other devices that use the same App Store / Google Play account via Settings → Restore Purchases. Entitlements are tied to your store account, not to us.

7. Apple App Store (iOS users only)

The following section applies only if you downloaded MineDown from the Apple App Store. Where it conflicts with other sections of these Terms, this section controls.

  • Parties. These Terms are entered into by you and Tafi Games only. Apple Inc. is not a party to these Terms and is not responsible for MineDown or its content.
  • Scope of license. The license granted in section 2 is limited to a non-transferable license to use MineDown on any Apple-branded products you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Maintenance and support. Tafi Games — not Apple — is solely responsible for providing any maintenance and support services. Apple has no obligation whatsoever to furnish any maintenance and support services.
  • Warranty. Tafi Games is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of MineDown to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to MineDown.
  • Product claims. Tafi Games — not Apple — is responsible for addressing any claims by you or any third party relating to MineDown, including (i) product liability claims, (ii) any claim that MineDown fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
  • Intellectual property claims. In the event of any third-party claim that MineDown or your possession and use of MineDown infringes that third party's intellectual property rights, Tafi Games — not Apple — will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party terms. You must comply with applicable third-party terms of agreement when using MineDown.
  • Third-party beneficiary. You and Tafi Games acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

8. Google Play (Android users only)

If you downloaded MineDown from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms, but Google Play's billing, refund, ratings, parental controls and content removal procedures may apply alongside ours.

9. No warranty

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND — EXPRESS, IMPLIED, STATUTORY OR OTHERWISE — INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT GUARANTEE THAT MINEDOWN WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF VIRUSES, OR THAT ANY SPECIFIC FEATURE WILL KEEP WORKING. YOU PLAY AT YOUR OWN RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAFI GAMES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) MINEDOWN — WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Where liability cannot be excluded, our aggregate liability to you for all claims arising out of or related to MineDown is limited to the greater of (a) the amount you paid for MineDown and its in-app purchases in the previous 12 months, or (b) USD 10 (ten United States dollars).

Nothing in these Terms limits or excludes any liability that cannot be lawfully limited or excluded under applicable consumer protection laws. Some jurisdictions do not allow the limitation or exclusion of certain warranties or liabilities, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Tafi Games and its affiliates from any claims, damages, liabilities and expenses (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the game, or (c) your violation of any law or third-party right.

12. Termination

You may stop using MineDown at any time by uninstalling it. We may suspend or terminate your access if you breach these Terms, if the game is discontinued, or for any other reasonable cause. Sections about ownership, no-warranty, limitation of liability, indemnification, governing law and the Apple-specific provisions in section 7 survive termination.

13. Children

If you are under the age of legal majority in your country, you may only use MineDown with the involvement of a parent or guardian who agrees to these Terms on your behalf. We do not knowingly direct the game at children under 13 (or the equivalent local threshold).

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally shall be brought before the competent courts of Istanbul, Türkiye, except where mandatory local law gives you the right to use a court in your country of residence.

Turkish consumers retain the rights granted by the Turkish Consumer Protection Law (Law No. 6502) and the Personal Data Protection Law (KVKK, Law No. 6698), notwithstanding any provision of these Terms.

Informal resolution. Before filing any formal claim, you agree to first contact us at info@minedowngame.com and make a good-faith effort to resolve the dispute for at least 30 days.

15. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire agreement

These Terms, together with our Privacy Policy and any platform-specific terms imposed by Apple or Google, constitute the entire agreement between you and Tafi Games regarding MineDown, and supersede any prior agreements regarding the same subject matter.

17. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms, in whole or in part, to any successor, affiliate, or in connection with a merger, acquisition or sale of assets, on at least 30 days' notice.

18. No waiver

A failure by us to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing.

19. Changes to these Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. For material changes, we will provide reasonable notice (e.g. in app release notes or via an in-app prompt). Continued use of the game after such notice constitutes acceptance of the updated Terms.
